1. Acceptance of Terms
novasearch is a product operated by Superfeedback OÜ, a private limited company registered in Estonia ("novasearch", "we", "us", "our"). By accessing or using novasearch.io (the "Site") or any novasearch service, you agree to be bound by these Terms of Use ("Terms"). If you do not agree, please do not use the Site.
2. Beta Status
novasearch is currently offered as a beta. Features may be incomplete, change without notice, or be discontinued. We make no commitment regarding availability, uptime, or fitness for any particular use during the beta period.
3. Eligibility and Accounts
You must be at least 18 years old and authorized to act on behalf of any business you represent. You agree to provide accurate information when requesting access and to keep your contact details current.
4. Acceptable Use
You agree not to:
- Use the Site in violation of any applicable law or regulation.
- Reverse engineer, decompile, or attempt to extract source code from our services.
- Interfere with the integrity, security, or performance of the Site.
- Use automated tools to scrape or harvest data without prior written consent.
- Submit content that is unlawful, harmful, infringing, or misleading.
5. Intellectual Property
The Site, including its design, text, graphics, logos, and underlying software, is owned by novasearch or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Site for its intended purpose. All other rights are reserved.
6. Your Content
Any feedback, suggestions, or materials you submit to us are non-confidential, and you grant novasearch a worldwide, royalty-free license to use them to operate and improve our services. You retain ownership of your underlying content.
7. Third-Party Services
The Site may link to or integrate with third-party platforms (such as Shopify, WooCommerce, and others). We are not responsible for the content, policies, or practices of those third parties. Your use of those services is governed by their own terms.
8. Disclaimer of Warranties
The Site and beta services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, or that the service will be uninterrupted or error-free.
9. Limitation of Liability
To the maximum extent permitted by law, novasearch and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenues, data, or goodwill arising out of or in connection with your use of the Site, even if advised of the possibility of such damages. Our aggregate liability for any claim relating to the Site or beta services is limited to one hundred US dollars (USD $100).
10. Indemnification
You agree to defend and indemnify novasearch and its affiliates from any claims, damages, or expenses (including reasonable legal fees) arising out of your breach of these Terms or your misuse of the Site.
11. Termination
We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including violation of these Terms. Sections that by their nature should survive termination will survive.
12. Changes to These Terms
We may update these Terms from time to time. When we do, we will revise the "Last updated" date above. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the Republic of Estonia, without regard to its conflict of law principles. Any dispute arising out of or in connection with these Terms will be resolved in the competent courts of Estonia, unless otherwise required by mandatory consumer protection law in your country of residence.
